These are the terms and conditions ('Terms of Sale') that apply when you purchase any products ('Products') from www.shop.jodipicoult.com Please read these Terms of Sale carefully before you make a purchase through the Site. You will be asked to confirm your acceptance of these Terms of Sale whenever you place an order for Products.
The Jodi Picoult webpage www.shop.jodipicoult.com (thereafter referred to as the ‘Webpage’) is operated by Open Management Limited and is the retailer of the products featured on this Webpage and any contract for sale of goods via the Webpage on these Terms of Sale is with Open Management Limited.
All orders are subject to stock availability.
We reserve the right to amend these Terms of Sale at any time and you should therefore check them each time you place an order via the Site. The Terms of Sale applying to your order will be those in place on the date that you place your order.
Product Descriptions, Prices and Availability
Whilst we try and ensure that all details, descriptions and prices which appear on the Site are accurate, errors may occur. Therefore all orders are subject to availability and confirmation of the order price.
If we discover an error in the price of any Products which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you choose to cancel your order and you have already paid for the Products, you will receive a full refund within 14 days.
If we are unable to supply you with a Product for any other reason, for example because that Product is not in stock or no longer available, we will inform you by email as soon as possible. If you have already paid for that Product, you will receive a full refund within 14 days.
Where applicable, prices are inclusive of VAT at the rate appropriate to the country of receipt.
Delivery costs will be charged in addition. Such additional charges are clearly displayed in the 'Total Cost' in the Basket. Further details of our delivery charges and polices can be found here
Payment may be made by credit or debit card Visa, MasterCard, American Express, and PayPal.
Your card will be charged or debited once the order has been accepted.
Because you are a consumer, we are under a legal duty to supply Products that are in conformity with these Terms of Sale.
As a consumer, you have legal rights in relation to Products that are faulty or not as described. These legal rights are not affected by your right of return and refund in this section 6 or anything else in these Terms of Sale. Advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.

If your product is goods the Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected life of your product your legal rights entitle you to the following:
Your right to cancel
You have certain rights under consumer protection legislation. Nothing in these terms and conditions is intended to affect those rights.
You have the right to cancel an order placed through the Site within 14 days. The cancellation period will expire after 14 days from the day on which you acquire or, if the order is a gift to be delivered to a third party, the third party specified by you in the order acquires, physical possession of the Products ('Cancellation Deadline').
To exercise the right to cancel, you must inform us of your decision to cancel prior to the Cancellation Deadline by a clear statement sent by email to firstname.lastname@example.org.
Effects of Cancellation
If you cancel an order, we will reimburse to you all payments received from you in respect of that order, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us). However, we will only pay the return costs where the goods are faulty, or not as described or where we are otherwise at fault.
We may make a deduction from the reimbursement for loss in value of any Products supplied, if the loss is the result of unnecessary handling by you.
We will make the reimbursement without undue delay, and not later than:
You must send back the Products to us at Open Management, [Dubow] 455 Lincoln Ave NE, St Cloud, MN 56304, without undue delay and in any event not later than 14 days from the day on which you notify us that of the cancellation of the order. You are responsible for the costs of returning the Products. We recommend that you return the Products using USPS’ Signed for service and obtain proof of delivery.
We will reimburse the monies due to you using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise. We may withhold reimbursement until we have received the Products back or you have supplied us with evidence that you have returned the Products to us, whichever is the earliest.
If we fail to comply with these Terms of Sale we are responsible for loss or damage you suffer that is a foreseeable result of our breach of these Terms of Sale or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if it is an obvious consequence of our breach or if it was contemplated by you and us at the time we entered a contract pursuant to these Terms of Sale.
We only supply the Products for domestic and private use. You agree not to use the Products for any commercial, business or resale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
We do not in any way exclude or limit our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or statutory implied terms as to title, quiet enjoyment and the description, satisfactory quality and fitness for purpose of Products.
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms of Sale or any order with you that is caused by an Event Outside Our Control.
If an Event Outside Our Control takes place that affects the performance of our obligations to you we will contact you as soon as reasonably possible to notify you, and our obligations to you will be suspended and the time for performance of our obligations will be extended for the duration of the Event Outside Our Control. Where the Event Outside Our Control affects our delivery of Products to you, we will arrange a new delivery date with you after the Event Outside Our Control is over.
You may cancel an order affected by an Event Outside Our Control which has continued for more than 30 days. To cancel please contact us. If you opt to cancel, you will have to return (at our cost) any relevant Products you have already received and we will refund the price you have paid, including any delivery charges.
No other person shall have any rights to enforce any terms of a contract made between you and us.
We may transfer our rights and obligations under a contract with you to another organization, but this will not affect your rights or our obligations under these Terms of Sale
You may only transfer your rights or your obligations under these Terms of Sale to another person if we agree in writing
If any part of these terms and conditions is deemed invalid, illegal or for any reason unenforceable then that part will be deemed deleted and will not affect the validity and enforceability of the remaining parts. Any failure by us to enforce our rights or remedies under these terms and conditions or otherwise shall not be construed as a waiver by us of those or any other rights or remedies.
